ABSTRACT
The recent approval of the law made under delegate powers on the subject of fiscal federalism, which implements article 119 of the Constitution, raises a number of questions such as in what way and by how much the health care sector will be influenced by it. The aim of this article is to go over the legal manoeuvres that are at the base of devolution in the health care system and to analyze the institutional conditions on which fiscal federalism is grafted so as to outline the future scenario on which the judiciary will have to reason and intervene.
