ABSTRACT
In Islam, the right to inherit for surviving dependants and relatives is based on Islamic principles. When a person dies without leaving a will, the inheritance goes to his or her next-of-kin as stipulated by the Syariah Law. Indeed there are laws on the distribution of inheritance in order to ensure that the inheritance rights of the next-of-kin are properly managed. The article discusses the procedures in the distribution of Muslim inheritance in Malaysia. In this regard, the jurisdiction of the different bodies that are involved in the distribution of Muslim inheritance in Malaysia, namely the High Court, the Small Estates Unit, Amanah Raya Berhad and the Syariah Court are discussed in this article.
